Terms of Service, Artisan Furniture, EU
This Addendum supplements and forms an integral part of the Master Terms of Service of Global Vision Direct Ltd t/a Artisan Furniture (“Seller”). Where there is any inconsistency, this Addendum prevails for all transactions conducted through the Seller’s European Union operations, including its website www.artisanfurniture.eu and its fulfilment centre located in Magdeburg, Germany and Madrid, Spain.
1. Governing Law & Jurisdiction
1.1 These Terms shall be governed by and construed in accordance with the laws of Germany, subject to applicable EU law.
1.2 The courts of Düsseldorf, Germany shall have exclusive jurisdiction over all disputes arising under this Addendum.
2. Warehouse & Fulfilment
2.1 Goods for EU customers are dispatched from the Seller’s EU fulfilment centre in Magdeburg, Germany and Madrid, Spain.
2.2 Risk in the Goods passes to the Buyer upon handover to the carrier at Magdeburg and Madrid. Title passes only upon receipt of cleared payment in full.
2.3 Deliveries are subject to EU-wide logistics networks, with surcharges applicable for remote regions or non-standard access points.
3. Pricing & Currency
3.1 All prices on www.artisanfurniture.eu are quoted in Euros (EUR), exclusive of VAT and duties.
3.2 Buyer is responsible for compliance with EU VAT frameworks, including but not limited to the One Stop Shop (OSS) system where applicable.
3.3 Seller shall not be liable for Buyer’s VAT or customs filings. Buyer indemnifies Seller against any liability arising from non-compliance with EU tax rules.
4. EU Compliance
4.1 Consumer Law Exclusion. All EU consumer protection directives (including the Consumer Rights Directive) are excluded, as these Terms govern strictly B2B transactions.
4.2 Product Conformity. Buyer is solely responsible for ensuring that all Goods meet applicable CE and UKCA conformity requirements where resale requires such certification.
4.3 Timber & Environmental. Buyer must comply with the European Timber Regulation (EUTR) and the European Deforestation Regulation (EUDR) for timber-based products.
4.4 Packaging & Waste. Buyer is responsible for compliance with EU packaging take-back obligations and extended producer responsibility rules under the Packaging and Packaging Waste Directive.
4.5 Privacy. Seller processes only limited business contact data. The EU GDPR applies solely to such data, processed under Seller’s Privacy Policy.
5. Returns (EU-Specific Procedure)
5.1 All returns must be initiated through the Buyer’s trade account portal under “My Returns” within 2 working days of delivery. Email requests will not be accepted.
5.2 Courier collections will only be arranged from the original EU delivery address. If Goods are moved, the return stands void.
5.3 Approved returns must be shipped back to the Magdeburg and Madrid fulfilment centre. Returns directed to other facilities will be rejected.
5.4 Refunds, where authorised, shall be processed in EUR and credited only to the original payment account.
6. Special Notes for EU Buyers
6.1 VAT & OSS. Buyer is responsible for correct VAT accounting under the IOSS framework or any other applicable EU VAT system.
6.2 Conformity & Safety. Buyer assumes full liability for ensuring CE conformity, UKCA (for resale into the UK), and compliance with EU fire safety or other mandatory product regulations.
6.3 Sustainability Compliance. Buyer must ensure compliance with EUTR/EUDR obligations for timber traceability and sustainability.
6.4 Language & Labelling. Buyer is responsible for compliance with local language, labelling, and consumer disclosure laws across EU member states.
